Pursuant to Legislative Decree No. 106 of 26 July 2023, implementing the delegation referred to in Article 2 of Law No. 118 of 5 August 2022, The Department of the Economy is engaged in setting up, at the Ministry of Economy and Finance, the information system for surveying public asset concessions (SICONBEP), whose ultimate goal is to increase the value of the concessionary assets and their efficient use.

Pursuant to Article 3 of Legislative Decree No 106 of 26 July 2023, the minimum information to be communicated to the SICONBEP portal being set up concerns:

1. (a) the nature of the property under concession,
2. (b) the owner entity and, if different, the managing entity;
3. (c) the particulars of the concessionaire;
4. (d) the method of awarding the concession;
5. (e) the identification number of the deed, contract or agreement governing the concession;
6. (f) the duration of the concession;
7. (g) renewals in favour of the same concessionaire, of a company controlled by it or affiliated to it within the meaning of article 2359 of the Italian Civil Code;
8. (h) the amount of the concession fee as well as any other data needed to verify the profitable economic use of the property with a view to protecting and enhancing the property in the public interest.

Discussions are ongoing with the various public administrations on the verification of information in databases and/or information systems held by them. Pursuant to Article 1 of the aforementioned legislative decree, coordination and interoperability with other existing information systems on public goods concessions will be ensured.

The technical specifications, methods and timing for sending the data to SICONBEP by the entities referred to in Article 2 are defined by the Ministry of Economy and Finance through guidelines, which will be adopted after consulting the Unified Conference referred to in article 8 of Legislative Decree No 281 of 28 August 1997 and published on its institutional website.

Previously, surveys on concessions were conducted pursuant to the Decree of the Ministry of Economy and Finance of 30 July 2010 implementing Article 2, Paragraph 222 of Law No. 191 of 23 December 2009.
